Error 500 when using pnpm newer than version "9.15.9"

I am currently updating two independent Nuxt3 apps to Nuxt 4. In both cases, NuxtImg throws error 500 when the packageManager Version is anything higher than "packageManager": "pnpm@9.15.9",

amazon-logo.png:1 GET http://127.0.0.1:3000/_ipx/_/img/logos/amazon-logo.png 500 (Internal Server Error)

The error i get is:
[500] [IPX_ERROR] Cannot find module '../data/patch.json'\nRequire stack:\n- /.output/server/node_modules/.nitro/css-tree@2.2.1/lib/data-patch.js

This is happening with a built nuxt project using pnpm 10.21.0

It's because of this specific line in css-tree:
const patch = require('../data/patch.json');

this is in node_modules/.nitro/css-tree@2.2.1/lib/data-patch.js

I was able to workaround this issue by making all of my css-tree versions the same in my project,
I overrided css-tree with version 2.2.1 which moved it out of the .nitro folder and into node_modules/css-tree.
